Vibhav Mithal is an Associate Partner at Anand and Anand, and an Artificial Intelligence and Intellectual Property rights lawyer. Vibhav focuses on AI holistically from a non-technical legal lens. Practicing as an IPR litigator for over a decade, Vibhav has been a part of many path breaking litigations such as the Aloys Wobben dispute (Supreme Court, 2014); Roche v. Cipla (Delhi High Court, 2015); Shree Nath v. ABD (Delhi High Court, 2015); Monsanto dispute (Supreme Court, 2019), Ferid Allani (Delhi High Court, 2019 & Intellectual Property Appellate Board, 2020); Anil Kapoor and Armasuisse (Delhi High Court, 2023). Vibhav regularly contributes to leading IPR publications such as Managing Intellectual Property magazine, Computer and Telecommunications Law Review, Asia Business Law Journal, the Intellectual Property Law Review, Patent Litigation Review, Mondaq Patent Litigation Guide and has also co-authored the India Chapter in Global Patent Litigation (3rd Edition, 2019) published by Bloomberg Law. He has been continuously recognized by Managing Intellectual Property as a Rising Star from the years 2022 to 2025.
On AI, Vibhav’s expertise lies in exploring legal and policy issues and offering practical solutions. Vibhav is one of the lead drafters for the ‘Developer’s Playbook for Responsible AI in India’ published by NASSCOM in November 2024, which was supported by the Government of India’s Ministry of Electronics and Information Technology, IndiaAI Mission, and Digital India Programme. The playbook is created to advance a common industry framework for developers to identify and mitigate AI risks. Vibhav also played a key role in shaping the Responsible AI Guidelines for Generative AI published in June 2023 by NASSCOM. These guidelines have been cited now in the Ministry's draft report on AI Governance released in January 2025. Vibhav has been involved in various AI policy initiatives and working groups in India, as a subject matter expert in AI.
Previously, Vibhav has also been cited for his views on AI Audits in Indiaai’s Generative AI Report. Vibhav has also co-authored two editions of the India Chapter of Artificial Intelligence Law, published by Lexology in July 2024 and December 2024. These chapters have been recognized as an authoritative guide for the voluntary guidelines and legal frameworks governing AI in the Indian context.
As a global thought leader, Vibhav has represented India as an AI subject matter expert at the Quad Critical Emerging Technology 1.5 Track Dialogue held in Japan. Vibhav has been inducted into the AI Forum for Developing Countries Forum, and represents India at the AIFOD Summits, which take place at the United Nations, such as the AIFOD Vienna Summit, 2025. He has also represented India in a Risk Management Focus group set up by the Institute of Internal Audits, Singapore. An expert in the AI & Partners’ EU AI Act Expert Series, Vibhav has co-authored articles that analyse various aspects of the EU AI Act.
To contribute to the AI ecosystem, Vibhav serves as an Associate Research Fellow with Centre for Responsible AI at IIT Madras; is engaged in the development of AI Audits (with ForHumanity, US); is the Chapter Head for the India AI Risk Chapter at the Risk and Insurance Management Association of Singapore (RIMAS); serves on the Peer Review Board of the Springer Journal – AI & Ethics and is the Global Ambassador for the Africa Tech and Development Initiative. He also advises various bodies such as Extended Reality Safety Initiative (XRSI, San Franciso) and iSpirit utilizing his unique AI lens.
