Elard Freiherr Schenck zu Schweinsberg joined the firm after studying mechanical engineering at RWTH Aachen University and training as a reserve officer and has been a partner since 2007. His main focus is on the technical fields of mechanical engineering, including manufacturing and production technologies, as well as automotive engineering, materials technology, medical technology, diagnostic equipment and physics. Elard Schenck zu Schweinsberg regularly acts in interdisciplinary teams and frequently collaborates with partners from the Department of Biology & Biotechnology on patent grant and opposition proceedings that concern inventions at the interface between mechanics/physics/mechanical engineering/IT and biology as well as biochemistry.
He has already obtained many successful patent office and court decisions for his clients, including the landmark BGH rulings "Partially Reflective Foil" (BGH X ZR 112/13) and "Wound Treatment Device" (BGH X ZR 161/12). Elard Schenck zu Schweinsberg is regularly recommended in rankings and well-known publications such as JUVE, Chambers and IAM Patent. IAM lists him as an "IAM global leader" in 2020 and the German magazine WirtschaftsWoche as one of the TOP lawyers for patent law. He is listed in the WWL: Germany 2024 Guide as one of the leading lawyers in Germany.
Elard Schenck zu Schweinsberg advises and represents his clients in all phases and areas of German, European and global patent portfolios. In addition to patent prosecution proceedings, he has many years of extensive experience in the field of opinion work, due diligence as well as in opposition, cancellation, nullity and patent infringement proceedings before the relevant jurisdictions and offices such as the German Patent and Trademark Office (DPMA), the European Patent Office (EPO), the Federal Patent Court (BPatG), the Federal Court of Justice (BGH) as well as the Higher Regional (OLG) and Regional Courts (LG). Elard Schenck zu Schweinsberg lectures on IP topics in Germany and abroad and advises start-ups, universities, SMEs and leading global companies on intellectual property issues. Elard was a member of the examination board for patent attorneys for many years.
