Dr. Olaf Malek joined the firm of VOSSIUS in 1999 and became a registered European patent attorney in 2004. He studied biology and did a Ph.D. thesis in the field of plant molecular biology.

Dr. Malek's expertise covers the entire field of patenting life science innovations, including the drafting of patent applications and their prosecution in various jurisdictions, in particular Europe and Germany, but also abroad. This includes counseling clients in the strategic management of IP portfolios.

Furthermore, Dr. Malek has ample experience in opposition and appeal proceedings before the European Patent Office. Currently, he is representing a party in the Enlarged Board of Appeal proceedings G 2/12 (the “tomato” case). Other famous cases with his participation are the BRCA/Myriad oppositions or the Neutrokine-alpha/BLyS case T18/09. Recently, Dr. Malek was involved in infringement litigation concerning an enzyme patent.

Dr. Malek regularly attends pertinent conferences and publishes in IP journals.

He is familiar with all kinds of technologies that are normally associated with “life science” in the broadest sense, i.e. molecular biology, genetics, biochemistry, therapeutic and diagnostic applications, food industry and, in particular, plant breeding. More specifically, he has handled cases which, e.g., concern cloned genes, DNA arrays, catalytic RNA, enzymes, cytokines, antibodies, glycobiology, transgenic plants, conventionally produced plants, diagnostic methods, protein and antibody purification methods, vaccines, pharmaceutical formulations, veterinary and human medicine, and food production.
