Benjamin Bai is an international partner with King & Wood Mallesons in Shanghai. He focuses on high-stake intellectual property disputes involving complex patents and trade secrets, especially in the cross-border context. Throughout his career, Benjamin has demonstrated a remarkable aptitude for navigating the complexities of international legal landscape and providing innovative solutions. Having worked in both law firms and corporations, he brings a rare perspective and deep understanding of the needs of clients. Unique to Benjamin is his ability to quantify risks and implement a risk-adjusted legal strategy, thereby earning him a winning track record in bet-the-company litigation and high-profile transactions.
Benjamin has blazed many new trails. During 2013-14, he acted as lead counsel for Novartis in China and obtained two preliminary injunctions against off-label use by generic competitors on its Glivec patent. The injunctions were the first of the kind in China. While in-house as the Chief IP Counsel for Ant Group, he led the patent team to build the largest blockchain patent portfolio in the world. Under his leadership, Ant’s patent portfolio blossomed by at least 30 times, making Ant one of the most innovative companies globally. His commitment to excellence and dedication to client service have garnered him a reputation as a trusted advisor. Managing Intellectual Property selected Benjamin as one of World’s 50 Most Influential People in IP 2020.
Benjamin joined King & Wood Mallesons in 2023. Previously, he was a partner with Jones Day and Allen Overy. He was Vice President and Chief IP Counsel of Ant Group and the Chief Legal Office of Amber Group.
Benjamin received his Ph.D. in chemistry from Rice University, and J.D. from the University of Texas School of Law.
