Mr. Mao is a trial lawyer with unparalleled winning track records and has secured several record-breaking damages awards in IP cases in China. He specializes in patent invalidation, patent infringement and trade secrets misappropriation lawsuits. He has represented renowned multinational companies in wining high-profile cases before the Supreme People’s Court (“SPC”), some of which were among the Supreme People’s Court’s Top 10 Intellectual Property Cases. His representation of multinational corporations in standard-essential patents licensing disputes, trade secrets, and software patents in courts around the country. As lead counsel, Mr. Mao has successfully orchestrated innovative strategy in challenging civil and commercial litigation and arbitration cases with huge damages.

Mr. Mao joined King & Wood Mallesons in 2011. From 2007 to 2011, Mr. Mao worked in the Patent Reexamination Board of the State Intellectual Property Office, primarily engaged in patent invalidation and administrative litigations. He has been admitted to the P.R. China bar since 2007 and became a Chinese patent attorney since 2010.

Representative cases:

  • Secured an injunctive order and damages awards of 220 million RMB for Golden Elephant in patent infringement and trade secrets misappropriation disputes. The client finally settled the case and received a total of 460 million RMB in compensation, making it the highest-paid IP case in China. The case is the No.1 of the 10 most influential cases for the past 5 years since the inception of Intellectual Property Court of the SPC.
  • Represented Sennics in trade secret disputes and secured a compensation of 201 million RMB, which is currently the highest compensation case for trade secrets disputes. The case was selected as one of the 10 most influential cases for the past 5 year since the inception of Intellectual Court of the SPC.
  • Represented Daiichi Sankyo successfully reversed the second-instance judgment before the SPC. This case created a judicial standard for amending and determining the inventiveness of Markush claims. The case was selected as top 10 IP Cases of 2017 by the SPC.
